Please read carefully. These Terms of Service govern your use of the ClearView website and your purchase of any services from ClearView Windows & Doors Pvt. Ltd. By requesting a quote, booking a service, or using our website, you agree to be bound by these terms.
Section 01

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and ClearView Windows & Doors Pvt. Ltd. ("ClearView", "we", "us"), registered at Shop No. 12, Pimpri-Chinchwad, Pune – 411018, Maharashtra, India.

By accessing our website at clearviewpune.in, submitting a quote request, accepting a written quotation, or engaging our services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use our website or engage our services. We reserve the right to update these Terms at any time. Continued use of our services following notification of changes constitutes acceptance of the updated Terms.

Section 02

Our Services

ClearView Windows & Doors Pvt. Ltd. provides the following services to residential and commercial customers across Pune and the surrounding region:

  • Supply and installation of uPVC, aluminium, and wooden windows
  • Supply and installation of front entry, interior, French, sliding, bi-fold, and security doors
  • Repair and replacement of existing windows, doors, glass, hardware, and seals
  • Custom design, fabrication, and installation of bespoke windows and doors
  • Mosquito mesh and fly screen supply and installation
  • Glass and aluminium partition systems for interior spaces

All services are subject to availability, site suitability assessment, and the specific terms set out in your written quotation. We reserve the right to decline any service request at our discretion.

Section 03

Quotes & Pricing

All prices quoted by ClearView are subject to the following conditions:

  • Validity: Written quotations are valid for 30 days from the date of issue unless otherwise stated.
  • Site conditions: Quotes are based on information gathered during the initial site survey. If site conditions differ materially from what was assessed — for example, concealed structural issues, non-standard openings, or access difficulties — we reserve the right to revise the quoted price. We will notify you of any changes before proceeding.
  • GST: All prices are quoted exclusive of Goods and Services Tax (GST) unless explicitly stated otherwise. GST will be added at the applicable rate on the final invoice.
  • Currency: All prices are in Indian Rupees (INR) unless otherwise stated.
  • Third-party costs: Quotes do not include costs for structural work, electrical work, painting, plastering, or other third-party trades that may be required as a consequence of the installation.
No surprise charges: We provide fully itemised written quotes before any work begins. You will never be charged more than the agreed quote without your prior written consent.
Section 04

Payment Terms

Our standard payment schedule is as follows. Specific terms may vary by project and will be confirmed in your written quotation:

  • Deposit (50%): A deposit of 50% of the total project value is required upon acceptance of the quotation and before fabrication or materials are ordered.
  • Balance (50%): The remaining balance is due on the day of installation completion, before our team leaves the site.
  • Large projects: For projects exceeding ₹5,00,000, a staged payment schedule (e.g. 40% deposit / 40% on delivery / 20% on completion) may be agreed in writing.
  • Accepted payment methods: Bank transfer (NEFT/RTGS/IMPS), UPI, cheque (subject to clearance before work commences), and cash up to ₹2,00,000 in accordance with applicable Indian law.
  • Late payment: We reserve the right to charge interest at 2% per month on overdue balances and to suspend or withhold any warranty claim processing until all outstanding amounts are settled.
Section 05

Cancellation & Refunds

5.1 Cancellation by Customer

  • Before fabrication begins: If you cancel within 48 hours of paying your deposit and before fabrication has commenced, we will refund 100% of the deposit.
  • After fabrication has begun: If cancellation occurs after materials have been ordered or fabrication has commenced, the deposit is non-refundable. In some cases, we may be able to recover a partial amount depending on the stage of fabrication — this will be assessed individually.
  • After installation: Once installation is complete and signed off, no refund is available. Any issues should be reported immediately and will be addressed under our warranty terms.

5.2 Cancellation by ClearView

We reserve the right to cancel a contract if site conditions make safe or satisfactory installation impossible, if access is repeatedly denied, or if unforeseen structural issues are discovered. In such cases, any deposit paid for unstarted work will be refunded in full within 14 days.

Custom orders: Custom-fabricated items (bespoke shapes, sizes, or finishes made to your specification) cannot be cancelled once production has begun, as they cannot be resold. Please ensure you are satisfied with your design approval before confirming fabrication.
Section 06

Installation & Site Conditions

The following conditions apply to all installation services:

  • Access: You must ensure reasonable access to the property and the relevant work areas on the agreed installation date. Additional access equipment (e.g. scaffolding, lift) required due to site conditions will be charged at cost.
  • Structural suitability: The openings into which products are to be installed must be structurally sound. We are not responsible for pre-existing structural defects. If we discover defects during installation, we will pause work and notify you before proceeding.
  • Preparation: Redecoration, plastering, or touching up of paintwork following installation is the customer's responsibility unless specifically agreed in writing as part of the project scope.
  • Society permissions: Where housing society approval or NOC is required for the installation, it is the customer's responsibility to obtain this before the installation date. We can provide technical drawings and specifications to support your application.
  • Safety: Our team will comply with all applicable health and safety requirements on site. Customers must ensure children and pets are kept away from work areas during installation.
Section 07

Warranty

7.1 Workmanship Warranty

All installation work performed by ClearView is covered by a 5-year workmanship warranty (1-year for repair services). This warranty covers defects in installation quality including water ingress due to improper sealing, hardware malfunction due to incorrect fitting, misalignment and operational issues caused by our installation, and structural defects caused by our workmanship.

7.2 Product / Manufacturer Warranty

All products (frames, glass, hardware) supplied by ClearView are covered by the respective manufacturer's warranty. This is typically 10–15 years for uPVC profiles, 10 years for aluminium frames, and 5 years for hardware components. Manufacturer warranty documentation is provided on completion of each project.

7.3 Warranty Exclusions

Warranties do not cover:

  • Damage caused by misuse, accidental damage, vandalism, or force majeure events
  • Normal wear and tear
  • Damage resulting from work carried out by third parties after our installation
  • Damage caused by structural movement or settlement of the building
  • Failure to follow our maintenance guidelines
  • Products or materials supplied by the customer
Section 08

Limitation of Liability

To the fullest extent permitted by applicable law, ClearView's total liability to you for any claim arising from or in connection with our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

We are not liable for:

  • Indirect, incidental, consequential, or special losses (including loss of profit, business interruption, or loss of data)
  • Loss or damage caused by events beyond our reasonable control (force majeure), including extreme weather, natural disasters, government actions, or pandemic restrictions
  • Any loss arising from your failure to follow our care and maintenance guidelines
  • Damage to pre-existing conditions that were not disclosed prior to the survey

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any other matter where liability cannot be excluded by law.

Section 09

Intellectual Property

All content on the ClearView website — including text, images, graphics, logos, design concepts, technical drawings, and 3D renders produced by our design team — is the intellectual property of ClearView Windows & Doors Pvt. Ltd. and is protected by applicable Indian copyright and intellectual property law.

You may not reproduce, distribute, modify, or use any content from our website or any design created by our team without our prior written consent. Custom design drawings and renders produced for you remain our intellectual property until full payment is received, at which point ownership of those specific designs transfers to you.

Section 10

Website Use

By using our website, you agree that you will not:

  • Use the website for any unlawful purpose or in any way that violates applicable law
  • Attempt to gain unauthorised access to any part of the website or its underlying systems
  • Transmit any malicious code, viruses, or harmful data
  • Scrape, harvest, or collect data from our website without our written permission
  • Use our website in any way that could damage its reputation or disrupt its availability

We reserve the right to restrict access to our website at any time without notice. We do not guarantee that the website will be available continuously or error-free.

Section 11

Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of India, including the Consumer Protection Act 2019, the Indian Contract Act 1872, and all other applicable statutes and regulations.

Any disputes arising out of or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India. We encourage you to contact us first to resolve any dispute informally — most issues can be resolved quickly and amicably through direct communication.

We aim to acknowledge all complaints within 2 business days and resolve them within 14 business days. Unresolved disputes may be referred to the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019.
